A lawsuit was filed against Merck & Co. in August of 2020 by a Rhode Island Woman who claims she was severely injured by the HPV vaccination, Gardasil.
She received her first injection of Gardasil when she was 13 years old, and received the second dose one year later in 2016. In the lawsuit, she states that she immediately experienced migraines, fatigue, dizziness, tinnitus, flu-like, and other symptoms. In 2016, following completion of the vaccination series, she was diagnosed with multiple autoimmune diseases, including fibromyalgia, orthostatic intolerance (OI), and postural orthostatic tachycardia syndrome (POTS).
The Centers for Disease Control (CDC) recommends the Gardasil vaccination for all boys and girls at the ages of 11 and 12. There are numerous states in the U.S. that have made the HPV vaccination a mandatory requirement for school attendance. Unfortunately, Rhode Island, where the lawsuit has been filed, was one of them.
What is Gardasil?
From its introduction to the market, Gardasil has been considered a “miracle vaccination” for being able to prevent all of the illnesses directly connected to contracting HPV in children and teens although they were not yet sexually active.
Gardasil is a vaccination designed to protect against the Human Papillomavirus (HPV), which is the most common sexually transmitted disease in the United States. Not only are HPV infections hard to detect once contracted, these infections will not go away on their own and can lead to the following health complications later in life:
- Cervical Cancer
- Vaginal Cancer
- Vulvar Cancer
- Penile Cancer
- Throat Cancer
- Anal Cancer
- Genital Warts
What Side Effects are Linked to Gardasil?
Numerous serious and debilitating complications of the Gardasil vaccination received by the plaintiff include:
- Weakness,
- Fibromyalgia,
- Chronic joint pain,
- Orthostatic Intolerance (OI),
- Abnormal gait,
- Extreme weight loss,
- Chronic fatigue,
- Gastrointestinal issues,
- Insomnia,
- Memory loss and cognitive issues,
- Dysautonomia,
- Postural Orthostatic Tachycardia Syndrome (POTS),
- and the inability to walk a significant distance without the use of a cane.
Why is there a Lawsuit being filed against Merck?
The lawsuit accuses Merck of purposely downplaying the potential risk of Gardasil; including a neurotoxic aluminum compound, a secret DNA adjuvant, and potentially hazardous DNA fragments of HPV.
Merck has been accused of negligence, failure to warn about side effects, manufacturing a defective drug, breach of warranty, fraud, and violation of the State’s Deceptive Trade Practices Act.
