Who is Responsible for an Uber Eats Delivery Driver’s Accident?

Figuring out which party is at fault in an accident can be tricky. It’s further complicated when you get into an accident with a driver for a food delivery service. Now, not only are the drivers and their insurance companies involved but the company the person was working for and any insurance company they may bring in. Any compensation made to someone for the accident can fall to any of these parties, and determining who is responsible can be difficult.

The Uber Eats Insurance Policy

There are times in which the insurance that UberEats has will cover at least part of the cost of the accident. Their current policy covers $1 million per accident. This primarily applies to third parties who were involved in the crash as they are covered as soon as the driver accepts the request to the moment the delivery has been completed.

Drivers who have their own valid auto insurance that includes a comprehensive plan and collision coverage are eligible to receive compensation from the company that covers the physical damage done to the vehicle, no matter who was determined to be at fault for the accident. A deductible of $1,000 is required before coverage begins.

The coverage listed above applies to the UberEats driver when they are actively making a delivery, but things get a bit trickier when a driver is in between deliveries but still has the app open and is available to make a delivery. This part of the policy only applies when the driver’s own insurance will not cover the damages and comes at set amounts that are much lower than the coverage available while making deliveries.

It covers:

  • bodily injury up to $50,000 for each individual
  • a total of $100,000 per accident
  • up to $25,000 for property damage

If you work for UberEats, it is important that you read through the insurance policy that you were given upon starting, and it may be helpful to speak with someone at your own insurance company about the coverage they can provide for work-related accidents. If for some reason, the insurance provided by UberEats does not cover your accident, responsibility for compensation could fall to the party who is at fault for the accident.

The insurance policy for UberEats applies only to those who are contracted with Portier, LLC. and do not live or operate in New York.
